the commissioner shall distribute all appropriate funds appropriated to the department to counties as needed to carry out these functions within the guidelines and timetables that are described in sections 256.045 and 260e.01. the department shall monitor the appropriateness of the spending of the funds and of the quality of the resulting services. in fiscal year 2017, for the purpose of achieving the minimum standards of quality for child welfare services established in this section, the department may require that each county have 20 full-time equivalent (fte) staff devoted to child welfare services. to the extent that a county is unable to offer services in compliance with this standard, funds for the county may be withheld until the county can demonstrate that it is in compliance. in fiscal year 2017, the department may by rule require the commissioner to establish a minimum grant allocation for each county. in fiscal year 2018, the commissioner shall establish a minimum grant allocation for each county. if a county demonstrates, by means of evaluation, that it has utilized the minimum grant allocation for that county for at least two consecutive years and that it is using the grant amount effectively, the grant allocation may be reduced.

(b) the department shall establish a statewide multi-year budget for the administration of child welfare services in which services are allocated based on need and the funding that the department receives in each year and the allocation of funds is based on an analysis of the following factors: (1) the projected needs of each child welfare area, (2) the projected needs of each family in child welfare, (3) the projected needs for the care and placement of abused and neglected children in treatment facilities, and (4) the current activities of the department. such an analysis shall be submitted in consultation with county social service agencies.

(c) a tribe that is approved for a project under this section shall have the responsibility to operate the project in an efficient and effective manner to achieve the intended goals of this section. the department or the commissioner may, in consultation with the tribe and the united states, establish a committee of tribal members to administer the project and to advise the committee on matters relating to operation of the project, including goals, policies, procedures, and standards of operation. the committee shall consist of no fewer than five members of a tribal council or other board approved by the tribe to be the advisory committee, one member of a tribal police department, one member of a tribal health department, one member of a tribal child welfare agency, and, if appropriate, two members of a social services agency in the community. members of the committee may be assigned by the committee to participate in the planning, operation, or evaluation of the project to the extent specified by the committee. the committee shall be advised of the criteria to be used in measuring the effectiveness of the project by the commissioner or, as the case may be, by the united states, the tribal committee, and the tribes participating in the project.
